Terms of Use

1.What MotorTrade is

MotorTrade is an online marketplace where private individuals and professional sellers ("Users") publish listings to sell or swap vehicles of any kind, from bicycles to boats and aircraft, in the United Arab Emirates, Saudi Arabia, Qatar, Kuwait, Bahrain and Oman.

MotorTrade is a platform only. We are not a party to any sale, swap or other agreement between Users, we do not own, inspect, store, deliver or guarantee any vehicle, and we do not handle the price of any transaction.

2.Eligibility and accounts

• You must be at least 18 years old and legally able to enter into contracts in your country of residence.
• Creating an account and drafting listings is free. You sign in with a one-time code sent to your email address.
• You are responsible for everything done with your account and must keep your email access secure.
• Professional sellers must select the Dealer account type and provide accurate company details, including a valid trade license when requested.
• You may hold only one personal account. Accounts are personal and may not be sold or transferred.

3.Listings

When you publish a listing you confirm that:

• you own the vehicle or are authorised by its owner to sell or swap it;
• the vehicle is not stolen, subject to undisclosed finance, seizure, police restriction or any other legal impediment, and may be lawfully transferred;
• the description, photos, price, year, mileage and condition are accurate and not misleading, and the photos show the actual vehicle;
• the listing complies with the laws of the country where the vehicle is located.

Listings must follow our Community Guidelines. We may edit the category of, refuse, pause or remove any listing, and suspend or close any account, that breaches these Terms or the Guidelines, without refund of the current period where the breach is serious.

4.Plans and paid options

• Publishing listings online requires an active monthly plan: Starter (up to 2 simultaneous listings), Premium (up to 10) or Business (unlimited). Current prices are shown on the Pricing page and in the app before purchase.
• Plans renew automatically every month until cancelled. You can cancel at any time; the plan stays active until the end of the paid period.
• Purchases made in the iOS app are billed by Apple and managed in your Apple ID settings. Purchases made in the Android app are billed by Google Play. Purchases made on the website are processed by our payment provider. The refund rules of the store you paid through apply.
• A plan bought on one platform unlocks your account on the website and the apps.
• If your plan ends or you move to a smaller plan, listings above your new limit are paused automatically. They are kept as drafts and can be republished later.
• Paid options (Bump to top, Featured 7 days, Swap Match) apply to one listing, are consumed once delivered and are not refundable except where required by law.
• We may change prices for future periods. Any change is announced in advance and never applies to a period already paid.

5.Dealing with other Users

Sales and swaps are concluded directly between Users, at their own risk. Before any transaction we strongly recommend that you meet in a safe public place, inspect the vehicle, check its registration and history with the competent authority (for example RTA, Absher or the local traffic department), and complete the ownership transfer officially. Never send a deposit or pay before seeing the vehicle and its documents.

In-app messaging is provided to help you communicate safely without sharing your phone number. Messages may be reviewed by our team when a report is made, to protect Users and prevent fraud.

6.Prohibited behaviour

• fraud, scams, fake listings, bait pricing or requests for payment outside a genuine transaction;
• harassment, threats, hate speech, spam or unsolicited advertising in messages;
• collecting other Users' data, scraping the Service or using automated tools without our written consent;
• circumventing plan limits, for example by using several accounts;
• any activity that is unlawful in the UAE or in the country where the vehicle is located.

7.Content and licence

You keep ownership of the photos and text you publish. You grant MotorTrade a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and adapt that content for the purpose of operating and promoting the Service, for as long as it is online. The MotorTrade name, logo and software belong to Healicore Softwares FZCO.

8.Liability

The Service is provided "as is". To the extent permitted by law, MotorTrade is not liable for the vehicles listed, the conduct of Users, the outcome of any transaction, or indirect losses. Our total liability to you for any claim is limited to the amount you paid us in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

9.Suspension and deletion

You can delete your account at any time from your account settings or as explained on the Delete account page. We may suspend or terminate accounts that breach these Terms. Deleting your account does not cancel a subscription billed by Apple or Google: cancel it in your store settings.

10.Changes, law and disputes

We may update these Terms. Material changes are notified in the Service or by email before they apply. These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Disputes are submitted to the competent courts of Dubai, without prejudice to any mandatory consumer protection rules of your country of residence.
